What is Medical Negligence?
Medical negligence in Ireland occurs when a healthcare professional fails to provide a reasonable standard of care, skill and judgement, resulting in harm to a patient. Medical negligence cases are typically held in court and there are no regulating bodies such as The Personal Injuries Assessment Board in personal injury cases.
Are there time limits to bring a medical negligence case?
Yes. Although there are exceptions, claims against a healthcare provider must be brought within two years of the date of the injury or when the claimant became aware of the injury. This is called the “date of knowledge”. Exceptions include cases where the injury or harm was not immediately apparent and cases involving minors. It’s important to seek legal advice as soon as you are aware that there may be an issue with the standard of care you received.
